Title: Right to Medical Mileage?
Question:
I recently injured my back at work. My employer's insurance carrier is now insisting that I see a doctor whose office is over 40 miles away from my home. I know there are back specialists whose offices are closer. Do I have to go to the doctor chosen by the insurance company? If so, does the carrier have to pay my travel expenses?
Answer:
The answer to the first question is, most generally, "yes." Iowa law clearly gives the insurance company the right to select the doctors for an injured worker during the entire healing period. At the same time the law states that the medical treatment "must be offered promptly and be reasonably suited to treat the injury without undue inconvenience to the employee." Although each claim will be judged on its own merits, cases which have been decided by the Iowa Industrial Commissioner in the past would indicate that agency would not find a 40-mile drive to be "inconvenient." Moreover injured workers who refuse to see a doctor selected by the carrier, run the risk of having their weekly benefits stopped during the period of that refusal.
The answer to your second question is always "yes." Although workers are not always informed of their rights in this regard, Iowa law states that insurers "shall allow reasonably necessary transportation expenses incurred" for medical treatment. At the present time, injured workers are entitled to receive 29 cents for each round-trip mile they drive for such treatment.
