Question:

Approximately five years ago I was involved in an accident at work where I caught my left arm in a press. My arm was subsequently amputated at the elbow; and, I have worn a prosthetic device since that point forward. My employer's workers' compensation carrier accepted responsbility for this claim, and covered the cost of the original prosthetic. However, the prosthetic has now worn out, and it is in need of replacement. The compensation carrier has informed me that they are only responsible for one prosthetic, so they have refused to cover the cost of the replacement. Are they right?

Answer:

No, they are not right. Under Iowa law, the compensation carrier is required to provide lifetime medical care as a result of your work injury. This means that they are required to cover the cost of your original prosthetic and any replacements which you require throughout your life. Moreover, the Workers' Compensation Commissioner has interpreted the law to require the compensation carrier to take care of any necessary maintenance for your prosthetic. This includes payment for any upkeep or repair which your prosthetic requires so long as it is not the result of an inappropriate use or abuse of the prosthetic.

In addition, if you are in need of any additional materials to protect your prosthetic, such as "production gloves" or moisture covers, the compensation carrier is required to provide for these as well. In short, the compensation carrier is required to do whatever is necessary, from a medical standpoint, to keep your prosthetic in working order.
