Title: Aggravation of a Preexisting condition?
Question:
I hurt my back in a lifting accident at work and have been off work for some weeks. The doctors say I have to have a surgery. The doctors also told me that the x-rays and other studies of my back show I had arthritis in my back before my accident. Based on these studies, the compensation carrier has now taken the position that my injuries are due to the pre-existing condition of my low back and has told me I am not eligible for medical or lost-time benefits. While I have had aches and pains in my back, I have never missed much work time in the past due to my back, nor have I ever been told that I needed surgery. What can I do?
Answer:
Our bodies can be worn down over time by illnesses, prior injuries, or by the aging process itself. These factors can make our bodies more vulnerable to an injury in the future. Iowa's workers' compensation law, however, provides that when a workplace incident significantly aggravates, or accelerates, or worsens, or lights-up these underlying or pre-existing conditions, a compensable claim results. Whether or not your claim is compensable depends in large part on the medical evidence, including the doctors' opinions. With proper development, many cases involving an aggravation of a pre-existing condition which have been denied by a compensation carrier are ultimately determined to be compensable.
